Acceptance of Terms
By accessing or using TiltedTrails (the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service. The Service is intended only for users who are of legal drinking age (21 or older in the United States).
Use of the Service
You may use TiltedTrails to discover wineries, plan trips, maintain a tasting journal, and manage winery listings if you are a winery owner. You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You may not misuse the Service, upload false or misleading information, attempt to gain unauthorized access to our systems, or use the Service to send spam or harmful content.
Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information when creating your account and to update it as needed. You must be at least 21 years old to create an account.
User Content
You retain ownership of content you submit to TiltedTrails, including tasting notes, photos, trip plans, and reviews. By submitting content, you grant us a license to use, display, and process that content within the Service. You are responsible for ensuring you have the rights to any content you upload, particularly photos. We reserve the right to remove content that violates these terms or is otherwise objectionable.
Winery Listings
Winery owners may claim and manage their listings on TiltedTrails. Claimed listings must accurately represent the winery and its offerings. We reserve the right to verify claims and revoke listing access if information is found to be false or misleading. Featured placement and event promotion are paid services subject to availability and our editorial discretion.
Subscriptions and Payments
TiltedTrails offers a Premium subscription and paid promotional features for winery owners. All payments are processed securely through Stripe. Subscription fees are billed monthly and automatically renew until cancelled. You can cancel your subscription at any time through your account settings. Refunds are subject to our refund policy and applicable law.
Intellectual Property
The Service, including its design, features, and content not submitted by users, is owned by TiltedTrails and protected by intellectual property laws. Winery information, ratings, and reviews may be sourced from public databases and third-party providers. Trademarks and logos belong to their respective owners.
Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy of winery information, hours, ratings, or availability. Driving directions and route suggestions are provided for convenience and should be verified. We are not responsible for your experiences at third-party wineries or restaurants. Always drink responsibly and never drink and drive.
Limitation of Liability
To the fullest extent permitted by law, TiltedTrails shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the preceding twelve months.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us.
Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new terms.
